Here's the deal. I sold a set of carbs on eBay and shipped them to a guy in Florida via UPS ground. I bought and printed the shipping label via Paypal (package was insured for full value). The guy just emailed me and told me that he just got the carbs and they were all busted up. My question is the following: How do you go about filing a claim with UPS? Who does the claim filing, the buyer or the shipper? Are there any other seller etiquette type things I ought to be aware of? This is the first time UPS has pooched something I shipped. :verymad:

Good luck! I just bought a supercharger for my truck, UPS dropped it destroyed the front snout, and blamed it on the packing company.

The Buyer has to contact UPS, they will come pick up the package and inspect it, to see whos fault it is. Here is where it gets tricky. UPS packing rules, the box "MUST" be able to sustain a 3ft drop, conveyors, and truck deck height. If they deem that it's was not packaged right, then it's up to the SHIPPER to cover the claim, and replace, repair, or refund. That is unless the box was packed by a shipping compnay, then you can fiel with them for the insurance...

I will be using FedEx from now on, this is my third filing in the last two months for claims with UPS, they plain out SUCK ASS.........

Ok, thanks for the heads up. I will tell the guy to file a claim with UPS. Do you have any idea how or where I should send him to do that? I packed the carbs pretty well, so I expect that it will pass their inspection, but you never know. I hate subjective crap like that, especially when it can screw me over.

The guy said that the cable adjusters on the top of the carbs were messed up and the choke knob was broken, so I am assuming something happened very similair to it getting run over by a truck.

It struck me as a bit odd as well. It definitely has crossed my mind that the guy is trying to screw me. I haven't heard back from him since I replied to his first email asking if the box was trashed. I know there wasn't anything wrong with them when I packed them up and the packing in the box was above my average pack job. We'll see what the guy comes up with when I ask him to file a claim with UPS. Atleast I did everything through Paypal, so he won't have much of a chance getting a charge back.

I would ask for pictures. First then go from there. I had a guy try to pull one over on my with a motor I sold him said the Head was all banged up.. I had packed it in Great stuff expanding foam, so there was no way then, the story changed to well... It was not banged up just had some goo on it and it looked messed up.

I had to file a claim before and everything worked out well, I did'nt even have to send the item in or anything...they said I may need to though. The buyer makes the claim, but they give the money to the seller, which I find kind of stupid.

Also, those parts are not very expensive at all. I bet for $30 you can have new choke assemblies and throttle cable adjusters for both carbs.

I have an extra set of tops that I can send him. If it came down to it I might hit you up for that choke. There is a long way to go before that happens though. I packed the box well and insured it, so even if the guy is trying to scam me, I am going to make him work for it. If UPS ran over the box, then they will get to have some fun with me.

So............I got an email from the guy this morning saying that the package doesn't look likme it was damaged during transit. I don't know what to do at this point because the carbs had absolutely nothing wrong with them when I shipped them and now he's saying the cable adjusters and choke knob are messed up. This deal is starting to smell kinda funny. What do you guys think I should do?

I am generally not one to give too many folks the benefit of the doubt. I fired him off an email asking to see some pictures of what he was talking about. The carbs were just stock carbs with a TORS eliminator kit on them and pod filters that I had left over from parting out a bike awhile ago. I even put a brand new throttle cable on them just to be nice. :verymad:
