Flag burning amendment?

Just wondering how many of you heard about this. The supreme court has held for a long time that flag burning is free speech, and struck down any law prohibiting it. Well apparently congress has a few times now tried to introduce a constitutional amendment banning flag burning. It just a few days ago went before the senate and only failed by 1 vote (it already passed the house). The supporters say it is a sacred symbol of our country that deserves protection. But I don't think that many people that support this amendment fully comprehend what it could mean. Our courts interpret the constitution to determine whether or not certain laws are allowed. If an issue is not expressly discussed, they have the ability to decide based on case law, and their interpretation of the constitution. An example is how freedom of speech is defined. Speech is a literal word, yet the justices have expanded it immensly, covering actions, written words, pictures and so on. How do we know that this amendment would not be used in the future to limit our freedoms?

Heres an example:

The wording of this amendment states "The Congress shall have power to prohibit the physical desecration of the flag of the United States". The flag is a sacred symbol of our nation right? So it should be protected. Well, our presidency is a symbol of our nation right? Its already illegal to say you want to kill the president. So lets make it illegal to burn an effigy of the president. Courts will probably uphold it, its a symbol, the flag is a symbol, the constitution protects the flag right? Well, now that desecrating an image of the president is illegal, well, cartoons desecrating the president are pretty similar too right? Lets make them illegal. Sounds kinda familiar now doesn't it? Like all the controversy about the islamic cartoons. We all scoffed at that, saying its just a picture, its free speech. Well, its just a piece of cloth.

 

Now sure I might be exaggerating there, but seriously, don't think for a second that our courts wouldn't interpret this amendment in other ways.

And yes my blood boils too everytime I see someone burning our flag, but thats the thing about our country, we have the freedom to disagree, to show our protest.

 

Right now in the world there are only 3 countries that ban flag burning, China, Cuba, and Iran.

Like I always say "USA the country of laws, not freedom"

 

Is it one of the reasons I got out of the military- Won't fight for a cause I don't believe in (oil) and this country is slowly tipping towards the very thing we fight (communism)

There is a fine line between government control and the will of the people, and I think there are a lot of people who forget that. This country was created with a set of rules to govern the people, created by the people for the people. Most polliticians these days don't view it that way anymore, they want to better their careers not their country. It is about time we the people stand up and say this is wrong and take our country back from those who swim in their own beurocratic bullshit....... :headbang:

 

I mean come on.......... our judges are now social workers, enough is enough. Bring back public executions (now thats reality TV), castrate child predators, fine attorneys who sue mcDonalds because their clients burned their tongue on hot coffee or a pickle (its hot). No more 16 years of appeals for death row inmates (appeals to the district court, then supreme court, then court of appeals, then US supreme court etc.) Inmates have rights my ass, they gave those up when they killed and raped a family, or shot an unarmed person.

 

And children don't get me started on that subject, because they have rights too. I mean you can't discipline your kid like I was because the schools teach kids that they can't be touched, instead of math, english, and science, you know the things they should know in order to function in society. I don't mean beat the shit out of them, but at least let them know that there are consequences for their actions. Then because they can't be disciplined they have no respect for anyone, so "little Johny, why did you shoot that man?" "Because I was not disciplined by my parents because the government wouldn't allow that, but its my parents fault I kill people."

 

It is going to come to a head here pretty soon, and I am going to sit back and laugh. Or at least sit on my patio with my 30-06 and 357 for the crime deterant aspect, and just watch.

 

Peoples common sense has went the way of the do-do, and it just saddens me to know that we have allowed this. They want everything for free and don't want to work for anything anymore.........

i think is just wrong to burn a flag, but why do we need a law to stop this or that.

Well said guys. We all know who's doing the burning and who's not. So why does it matter ? They shouldn't even be here . Like Gargamel said, slowly tipping to what we are fighting (communism) . The whole government agenda today is about CONTROL . Controling every aspect of your life . What we need is a good old fashioned REVOLUTION . Starting at the top. Weed out all the BS.

But its not even communism that we're leaning towards (or socialism, or fascism), its something else entirely. Communists are about the workers uniting to bring down the capitalists. The workers own the means of production, and everyone is given what they need (think star trek). They're trying to take down the capitalists. Yeah I know, thats not how the Soviet Union worked, but they weren't communist, thats just what we called them (United Soviet SOCIALIST Republic).

Here, what we're doing is giving enough handouts and welfare to keep the masses out of poverty so they think they have it good. Meanwhile, the rich just keep getting richer and finding new ways to hold us down and pull the wool over our eyes.

And revolution would be a good idea. The basic idea of our government isn't bad, but where there is wealth and power to be had, there will be corruption. You have to take the ability to gain wealth, and hold power over other people completely out of the government. And get rid of the political parties too.

The government pays Bush, what 400k a year to look after our interests. And he gets about 1.2 billion for all his global oil triumphs.

Your right this is a country of laws. Laws like the one that keeps people like me from kicking the shiit out of people like you for saying stupid shit.

 

As far as flag burning goes, fine burn the flag. But then leave our country and never come back. I am tired of hearing people complain about losing their freedoms. It is the price you pay for living in a world where people want to do you harm. If WE do not give up some of our freedom to help OUR government protect us then the people who want to harm us will find it way to easy to do so and to hide behind our very noses.

If you find our laws to constritive try living in (Insert country here)!!
